Avatar Arc Participant Agreement, Waiver, and Release of Liability

1. About the program
Avatar Arc ("the Program") is a personal growth and coaching experience operated by Astralis LLC and Yauri de Groot ("we," "us," "our"). It may include physical activity, movement and conditioning, striking or boxing practice, breathwork, cold water or ice immersion, heat exposure, meditation, guided visualization and active imagination, reflection and journaling, and one on one or group conversation. Participation is entirely voluntary.
2. Definitions
"You" and "I" mean the participant. "Released Parties" means Astralis LLC, Yauri de Groot, and their owners, members, managers, coaches, employees, contractors, volunteers, partners, and agents. "Claims" means any claim, demand, liability, damage, loss, cost, or cause of action of any kind.
3. Not medical, health, psychological, or financial advice
We are not acting as your physician, therapist, psychologist, counselor, dietitian, or financial advisor, and nothing in the Program is medical, mental health, therapeutic, nutritional, or financial advice, diagnosis, or treatment. The Program is not a substitute for care from a licensed professional. Always seek the advice of qualified professionals with any questions about a medical or mental health condition or a financial decision. Never disregard or delay professional advice because of anything in the Program. In an emergency, call 911 or your local emergency number.
4. No professional relationship
Participating in the Program does not create any physician and patient, therapist and client, counselor, or fiduciary relationship between you and the Released Parties.
5. Assumption of risk
I understand that the activities in the Program carry inherent and unforeseeable risks. These include muscle strains, sprains, fractures and other injury, cardiac or respiratory events, aggravation of pre existing conditions, adverse reactions to cold, heat, or breathwork, drowning, fainting, emotional or psychological distress, illness, and in rare cases permanent disability or death. I knowingly, freely, and voluntarily assume all such risks, both known and unknown, even if they arise from the ordinary negligence of the Released Parties.
6. Specific activity warnings
I understand that breathwork can cause lightheadedness or fainting and must never be done in or near water or while driving. I understand that cold water and ice immersion carry risks including cold shock, hypothermia, and cardiac stress, and that I should never do them alone in water. I agree to follow instructions, to move at my own pace, and to stop any activity that does not feel safe for me.
7. Health representation and disclosure
I confirm I am at least 18 years old and physically and mentally able to participate. I have consulted a physician where appropriate. I will disclose any condition, injury, pregnancy, or medication that may affect my safety, will listen to my body, and will stop and seek medical help if I feel unwell. I participate at my own risk and take full responsibility for my own wellbeing.
8. Consent to emergency care
If I am injured and cannot give consent, I authorize the Released Parties to arrange emergency medical care on my behalf. I understand I am responsible for the cost of any medical care I receive.
9. Release and waiver of liability
To the fullest extent permitted by law, I release, waive, discharge, and agree not to sue the Released Parties from any and all Claims arising out of or related to my participation in the Program, including Claims based on the ordinary negligence of the Released Parties, to the maximum extent allowed by law.
10. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any Claim, including reasonable attorneys fees, arising out of my participation, my use of any material, or my breach of this Agreement.
11. Emotional and psychological acknowledgment
Some practices may surface strong emotions or memories. I understand the Program is not therapy and does not replace mental health treatment. I take responsibility for my emotional wellbeing and will seek appropriate professional support if I need it.
12. No guarantee of results
Outcomes vary from person to person. No specific result, improvement, or benefit is promised or guaranteed.
13. Confidentiality and respect for others
In group settings, I will keep private anything personal that other participants share, and I will treat others with respect.
14. Intellectual property
The methods, materials, recordings, and content of the Program belong to Astralis LLC and are provided for my personal use only. I will not copy, sell, or distribute them without written permission.
15. Consent to communications
I consent to receive emails and messages from Avatar Arc related to the Program. I may opt out of non essential messages at any time.
16. Consent to collection of information
I consent to the collection and storage of the responses I provide when I onboard, and their use to understand and tailor my experience, in line with the Avatar Arc privacy practices.
17. Media Release
When I onboard I may grant Astralis LLC and Avatar Arc, and anyone they authorize, the irrevocable, perpetual, worldwide, royalty free right and permission to photograph, film, and record me, and to capture my name, voice, image, likeness, and statements during the Program. This permission allows them to use, reproduce, edit, adapt, publish, distribute, and display that material, in whole or in part, in any media now known or later created, including websites, social media platforms such as Instagram, YouTube, TikTok, Facebook, and others, newsletters, podcasts, courses, advertising, and promotional materials, for documenting, teaching, and promoting the work of Avatar Arc. I understand this material may be public, may be shared, reposted, and downloaded by others, may remain online indefinitely, and that I will receive no payment for its use. I waive any right to inspect or approve the finished material and release the Released Parties from any Claim arising from this use, including claims for compensation, defamation, invasion of privacy, false light, or right of publicity.
18. Voluntary participation
My participation is voluntary and I may withdraw at any time.
19. Governing law and venue
This Agreement is governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought only in the state or federal courts located in the State of Florida, and I consent to that jurisdiction.
20. General
If any provision is held unenforceable, the rest remains in effect. No failure to enforce any part is a waiver of it. This is the entire agreement between us on its subject matter and may be updated from time to time; the version in effect when I participate applies. By agreeing when I onboard, I acknowledge I have read, understood, and agree to this Agreement, and that my electronic acceptance is legally binding.
